THE LEGAL PROFESSION
In Scotland the Law Society of Scotland represents solicitors. The governing body in Northern Ireland is the Law Society of Northern Ireland.
The Courts and Legal Services Act 1990 confirmed the existing advocacy and litigation rights of barristers and solicitors.It also opened the way for the professional bodies to apply for these rights for their members, either as completely new rights or by extending the existing rights. The Law Society in England has already applied to extend solicitors` rights of audience to the higher courts. In Scotland they have been granted rights of audience in the Supreme Courts.
Under recent proposals a lawyer would be able to have fees increased by 20 percent if he or she won a case concerned with personal injury, insolvency, and an application to the European Courts of Human Rights.
Lawyers` professional bodies have arrangements for dealing with complaints from the public about barristers, advocates and solicitors. Legislation passed in 1990 strengthened the complaints system by creating legal services ombudsmen in England and Wales and in Scotland to investigate allegations about the way complaints have been dealt with by the professional bodies. Similar proposals regarding legal services in Northern Ireland are being considered.
