Equal Justice
1. In theory all Americans charged with a crime are, as far as the law is concerned, equal before the justice. Unfortunately, there can be no equal justice where the kind of trial a man gets depends on the amount of money he has.
2. It should not be forgotten that the problem of equal criminal justice is not a question of the very poor alone but of the average wage-earners as well.
3. After arrest the accused who is poor must often await the disposition of his case in jail because of his inability to raise bail while those who can afford bail return to their families and jobs.
4. In preparing for trial the lawyer appointed to represent an accused who is without funds generally has few, if any, of the investigatory resources available for the prosecution or to accused with means. The appointed attorney not being given an opportunity to ascertain facts, the accused basic right to effective representation is grossly violated.
5. The poor should receive equal access to probation and parole. But after conviction the defendant's financial condition may have a significant effect on whether he is placed on probation or sent to penitentiary. The alternative fine imprisonment penalty imposed for petty offences may also be unfair to the defendant without means.
6. The $ 3,000 annual family income is known to be the official boundary of poverty. It is clear that if any member of 10,000,000 American families which fit into this category were accused of a serious crime, he could not raise the funds necessary for an adequate defense. It is also doubtful whether half of the families of this affluent country could today afford it. Perhaps they would raise enough money for bail or even for a trial lawyer, but what about the investigator, a psychiatrist or аn expert in ballistics or handwriting?
This is a situation many American families are confronted with each year. One law for the rich and another for the poor.
