The lawyer
The role of the lawyer is extremely important. The lawyer must serve the interests, not just of his client, but also the interests of justice.
The Canons of Legal Ethics of the Canadian Bar Association put it well: “The lawyer is more than a mere citizen. He is a minder of justice, an officer of the courts, his client’s advocate and a member of an ancient, honorable and learned profession. In these several capacities, it is his duty to promote the interest of the State and serve the Courts of Justice, maintain the authority and dignity of the Courts, be faithful to his clients, candid and courteous in his intercourse with his fellows and true to himself”.
A lawyer has a duty to keep his client’s business secret. A lawyer should not undertake any work which he is not competent to perform. A lawyer should act at all times with integrity and independence. The fee charged must be fair and reasonable having regard to all the circumstances of the transaction. A lawyer’s word is his bond and if he enters any agreement or makes any undertaking, he should abide by what he has agreed to do.
